GENERAL TERMS AND CONDITIONS
COMPLETE AGREEMENT. THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND NATIONAL ID RECOVERY. LLC (NIDR). AND IT SUPERSEDES ALL PRIOR ORAL AND WRITTEN PROPOSALS AND COMMUNICATIONS PERTAINING TO THE SUBJECT MATTER HEREOF. It is the consumer’s duty to register their service agreement immediately upon receipt. Our Services and those of our partners will not be provided if registration has not been completed. There is a 10 day waiting period, starting at the time of registration, before we or our partners will provide ID Recovery Services. No services will be provided for any event that occurs prior to the expiration of this 10 day period.

LIMITATION OF LIABILITY
CONSUMER’S SOLE AND EXCLUSIVE REMEDY AND OUR AND OUR PARTNER’SENTIRE, COLLECTIVE LIABILITY IN CONTRACT, TORT OR OTHERWISE, UNDER THIS SERVICE DESCRIPTION IS A REFUND OF THE AMOUNTS PAID FOR THE SERVICE THAT IS THE BASIS OF THE CLAIM.

CONSUMER ACKNOWLEDGES AND AGREES THAT THE SERVICES DESCRIBED HEREIN ARE BEING PROVIDED BY NATIONAL ID RECOVERY, LLC. NIDR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE RESULTS OF THE ID RECOVERY SERVICES INCLUDING, WITHOUT LIMITATION, RESPONSES TO ANY RECIPIENT OF NIDR SERVICES..IN NO INSTANCE SHALL NIDR BE LIABLE FOR DIRECT, SPECIAL, INDIRECT, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO, LOSS OF USE, DATA, OR PROFITS, WITHOUT REGARD TO THE FORM OF ANY ACTION, INCLUDING BUT NOT LIMITED TO CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTIONS, ALL ARISING OUT OF OR IN CONNECTION WITH THE SERVICES PROVIDED BY THE SERVICE PROVIDER.

GOVERNING LAW; ARBITRATION
Any dispute arising from this Agreement or the Services provided hereunder shall be governed by Georgia law, without regard to conflict of law principles. Consumer agrees that, except as set forth in this paragraph, any and all claims or disputes arising out of or in connection with or in relation to this Agreement of the Services provided hereunder will be resolved by final and binding arbitration. All arbitration proceedings will be held in the office of the American Arbitration Association closest to consumer’s permanent residence. Any arbitration that arises out of this Service will be held in accordance with the American Arbitration Association’s Commercial Arbitration Rules. The Federal Arbitration Act, 9 U.S.C. § 1, et seq., shall govern all arbitration proceedings under this Agreement or related to the Services provided hereunder.

GENERAL
Nothing in this Agreement affects any statutory rights of consumers that cannot be waived or limited by contract. Please retain a copy of your invoice to establish proof of entitlement to the Service. Both you and NIDR agree that under this Agreement, all information exchanged is confidential.

Neither you, CTTC intermedia, Inc nor NIDR will bring a legal action, under this Agreement, more than two years after the cause of action arose unless otherwise provided by local law without the possibility of contractual waiver or limitation. Neither you, CTTC intermedia nor NIDR are responsible for failure to fulfill any obligations due to causes beyond its control.

You may not assign, or otherwise transfer, this Agreement or your rights under it or delegate your obligation without prior written consent. Any attempt to do so is void. In the event that any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of this Agreement remain in full force and effect. Neither NIDR, CTTC intermedia, inc. nor you may institute any action in any form arising out of this Agreement more than eighteen (18) months after the cause of action has arisen, or in the case of nonpayment, more than eighteen (18) months from the date of last payment.

With regard to any services that are not within the coverage of this Agreement, it will be within CTTC intermedia, inc.’s and NIDR’s discretion whether to perform the services, and, if CTTC intermedia, inc. and NIDR elects to perform the services, the services will be subject to an additional charge to be paid by you.
